Kieran Maguire: Everton had no ‘new evidence’ to reduce points deduction with verdict days away

Everton had no ‘new evidence’ to present in their points deduction appeal and instead argued that there were flaws in the initial verdict.

That is the view of finance expert Kieran Maguire, who exclusively told Football Insider that Everton’s defence is based on finding ‘flaws and contradictions’ in the 10-point penalty verdict.

The Toffees were deducted 10 points in November after being deemed guilty of breaching Premier League Profit and Sustainability Rules.

The Merseyside club immediately appealed the decision and the second hearing concluded last week with a verdict expected in mid-February.

Everton are now face a second charge of breaching financial rules following the release of their latest 2022-23 accounts.

Maguire explained that Everton’s defence does not include any ‘new evidence’ about their finances.

“The evidence presented in Everton’s appeal is going to address the procedural activities of the initial commission rather than the submission of new evidence,” Maguire told Football Insider’s Sean Fisher.

“So Everton’s legal team must find flaws and contradictions in terms of the way that the 10-point penalty was determined. 

“That is going to be the best part of their defence.

“If you read the commission’s report from front to back, at times it does not present Everton in a particularly favourable light.

“However, the club initially went from trying to claim that they were under the FFP limit to then acknowledging that there had been errors.

“Whether that was worthy of a 10-point deduction is for people far smarter than me to decide.“
