Kane County Court News: Man indicted in 2020 Elgin murder, attempted murder case; Elgin man gets life term for sexually assaulting 2 children

A 23-year-old man who allegedly fired a gun into a car in Elgin, killing one man and injuring another, has been indicted by a Kane County grand jury on murder and attempted murder charges.

Dru K. Jarvis, of the 1300 block of Cunat Court in Lake in the Hills, was a passenger in a car southbound on Route 31/North State Street on Aug. 22, 2020, when the driver pulled alongside a car near the intersection of Kimball Street, a Kane County State’s Attorney’s Office news release said.

Jarvis is believed to have pulled a gun and fired at the two men inside the other vehicle, hitting the driver and his passenger, Francisco Trujillo-Uscanga, a 41-year-old Elgin resident, the release said.

Trujillo-Uscanga died a short time later at AMITA Health St. Joseph Hospital in Elgin.

Both men were hit with multiple gunshots. They were en route home from their jobs as cooks at a Huntley restaurant, the release said.

In addition to first-degree and attempted first-degree murder, Jarvis was also indicted on charges of armed violence, a class X felony, and unlawful possession of a weapon by a street gang member, class 2 felony

Jarvis’ bail is set at $750,000. His next court appearance is scheduled for Dec. 7.

José A. Tamayo, a 33-year-old Elgin man, was sentenced to life in prison for the sexual assault of two children under the age of 13 between between January 2018 and May 2019, the Kane County State’s Attorney’s Office said.

Tamayo, of the 200 block of Illinois Court, was sentenced by Judge Salvatore LoPiccolo Jr. after being found guilty by a Kane County jury in February of three counts of predatory criminal sexual assault, a class X felony, and four counts of aggravated criminal sexual abuse, a class 2 felony, a news release said.

Tamayo knew both victims, and faced a mandatory life prison sentence because he was convicted of predatory criminal sexual assault against multiple victims, the release said.

“This sentence places Mr. Tamayo where he belongs and where he can no longer cause harm to society,” Assistant State’s Attorney Matthew Rodgers said.

Bond was set at $200,000 for a 28-year-old Carpentersville man arrested on charges related to pointing a gun at a person about 3 a.m. Sunday on Douglas Avenue in Elgin, police said.

Jose Acosta Jr., of the 7000 block of Lowell Drive, was charged with one count each of armed habitual criminal, possession of firearm by street gang member on land, felon possessing or using firearm when on parole, aggravated unlawful use of a weapon in public, previous felony conviction possession of a firearm, no Firearm Owner’s Identification Card and three counts of aggravated unlawful use of a weapon, authorities said.

The victim told police they were in the 300 block of Douglas Avenue when a man, later identified as Acosta, approached them while walking his dog, pointed a handgun at them and then left, a news release said.

Officers were able to find Acosta and the dog in the area and recovered the firearm he had thrown away after he tried to flee, the release said.

Acosta is being held in the Kane County jail. His next court appearance is scheduled for Nov. 2.
