Trial date set for man facing 26 sex charges

WARREN — A trial date has been pushed back for a Leavittsburg man facing 26 sex charges including rape and gross sexual imposition of three girls ages 11, 16 and 17.

Brian Harvey, 43, appeared before Trumbull County Common Pleas Judge Cynthia Rice where he waived his rights for a speedy trial allowing his jury trial set for Monday to be pushed back to Oct. 16.

Harvey was indicted by a Trumbull County grand jury on 14 counts of rape, five counts of gross sexual imposition and seven counts of sexual battery for alleged assaults that took place between July 2022 and March 2023.

The indictment indicates that Harvey sexually assaulted all three girls. According to the indictment, two of the victims, the 16- and 17-year-olds, are developmentally disabled. The gross sexual imposition charge pertains to charges involving the 11-year-old victim.

In April, Harvey entered a plea of not guilty during his arraignment on the charges and was given a bond of $500,000.

A hearing will begin July 26 to discuss pending motions among legal counsels in Rice’s courtroom before a final pretrial hearing Sept. 9.
